Course Description

The seminar takes up the distinction between private and public provision of goods and services (including, among others, speech moderation on social media platforms, corrections, national security, health, education, and welfare). It explores the legality and desirability of deciding between these two alternatives. Some of the exploration is made at the micro level, focusing on particular—historical and contemporary—contexts such as law enforcement, tax collection, and risk regulation. In addition, this course tackles the macro level questions of what is the value of holding private persons responsible for the provision of some goods and services, are there principled arguments for distinctively public provision of them, and why distinguishing between the "private" and the "public" might matter in the first place.
