Course Description

This course will examine the remedial and procedural aspects of litigation to enforce constitutional and other public-law rights. Students will consider the causes of action, remedies, and procedural mechanisms available to plaintiffs in constitutional cases, as well as the jurisdictional bars, immunities, and other defenses available to government defendants. Students will achieve a comprehensive understanding of our system for enforcing constitutional rights, and will develop critiques suggesting how that system might be improved. Reading will consist primarily of contemporary legal scholarship. Students will be evaluated based on class participation and a final paper on a topic of their choice.
